Home owners will be required to get a POOL SAFETY CERTIFICATE by a licensed Pool Inspector at point of sale or lease if their property has a pool.
When selling your property you must now provide the buyer with a copy of your pool safety certificate. If you don't, you will need to complete a Disclosure Statement and give this to the buyer. The buyer then has only 90 days to get a pool safety certificate for the pool.

There is a phase in period of 5 years for all residential home pools and spas to comply with the pool fence compliance laws unless you sell or lease your property first.
Without a pool that complies the risks are high should a drowning or submersion injury occur in your pool. It's bad enough dealing with the loss of a life, imagine being left with a harrowing law suit if your pool is found to be non-compliant with the standards. It's not worth the risk of a life or law suit when you can have your pool inspected.
Landlords will have no choice but to get a pool safety certificate from 9th July, 2011 - If you own a rental property and want your current tenant or new tenant to sign a lease YOU MUST HAVE A POOL SAFETY CERTIFICATE if the lease is signed after 8 july 2011 to show that your pool complies with the new pool safety legislation before you can legally lease your property.

The new pool safety laws aim to further reduce the incidences of drowning and serious immersion injuries of young children in swimming pools.
Queensland's swimming pool safety improvement strategy has two stages.
Stage 1 was introduced on 1 December 2009 and applies to new residential pools.
Stage 2, The final stage of the swimming pool safety laws is expected to start this summer (December 2010). Stage 2 mostly affects existing swimming pools. It is important that all pool owners are familiar with these new laws.
