Body corporates & Community title schemes under the new legislation will require a pool safety certificate within the phase-in period if:
- An owner of one of the properties/lots wishes to RENT their property by signing a new rental agreement or renew an existing rental agreement.
There is a phase in period for body corporates, however the risks are high should a drowning or submersion injury occur in your pool. You could be left with a harrowing law case if your pool is found to be non-compliant with the standards.
Short-Term Accommodation providers such as Hotels & Resorts MUST have a pool safety certificate within 6 months of the legislation. The new legislation states that a room can not be let for money if they don’t have a certificate of compliance in place come 31st of May 2011.
We advise hoteliers and accommodation providers alike to have their pools inspected as soon as possible. There will be a rush to amend pool fences and barriers that comply with the new standards of the Queensland Development Code.
Keep in mind that if your pool fence requires more than $3300 (inc GST) of works to comply you will be required to hire a QBDSA licensed contractor. If the fence repairs required exceed 5 meters of fencing a Building Application (BA) should be lodged with your local council.
On top of this, your local fencing contractors will likely be snowed under and unable to service you for some time due to the massive number of jobs they will be hit with. It is estimated that 95% of pools in Queensland will not pass the pool safety inspection in accordance with the latest standards.

Caravan Parks, Backpackers & Hostels
These accommodation providers also fall under the short term accommodation category hence the same 6 month phase-in period applies to Caravan Parks, Backpackers & Hostels as it does to Hotels, Motels and Resorts.
You will need a Pool Fence Safety Inspection to obtain a Pool Safety Certificate - FORM 23.
The new pool safety laws aim to further reduce the incidences of drowning and serious immersion injuries of young children in swimming pools.
Queensland's swimming pool safety improvement strategy has two stages.
Stage 1 was introduced on 1 December 2009 and applies to new residential pools.
Stage 2, The final stage of the swimming pool safety laws is expected to start this summer (December 2010). Stage 2 mostly affects existing swimming pools. It is important that all pool owners are familiar with these new laws.
